In a recent case, the issue was whether a van drove down a road with its lights ‘on’ or ‘off’. The driver of the van claimed the lights were on. Our client believed that that the lights were off. There were no other witnesses. Liability for a serious accident hinged on the answer. We retained an accident reconstructionist who examined the broken headlamps on the van and was able to prove that the lights were, in fact, ‘off’. The right expert in this case was the reason that the client's belief was established as determinative fact.
